AQUAGOLD® VIP Terms & Conditions

1. Overview

AQUAGOLD® VIP is a private, account-based purchasing platform where customers place orders and may receive bonus credit as part of a loyalty program.

By accessing or using the Platform, you agree to these Terms & Conditions and the Privacy Policy. If you do not agree, do not use the Platform.

2. Access and Account Responsibility

AQUAGOLD® VIP may restrict access to approved customers, providers, and authorized users.

AQUAGOLD® VIP may limit, suspend, or remove access for accounts that are inactive, unqualified, or inconsistent with platform usage expectations.

AQUAGOLD® VIP may suspend, restrict, or terminate access if an account is inaccurate, unauthorized, fraudulent, or in violation of these Terms.

• Maintain accurate account information.
• Protect your login credentials.
• Remain responsible for all activity conducted through your account.

3. Eligibility and Provider Requirements

You must be at least 18 years old to use the Platform.

You are responsible for ensuring compliance with all applicable laws and professional standards.

• If registering as a provider, you confirm that you are licensed or authorized to perform applicable services.
• If registering as a provider, you confirm that you are permitted to purchase and use professional products.

4. Acceptable Use

You agree not to misuse the Platform or use it in a way that interferes with AQUAGOLD® VIP, its users, partners, products, service providers, or systems.

AQUAGOLD® VIP may take action, including account suspension or cancellation of orders, if misuse is detected.

• Do not bypass platform controls, authentication, or security.
• Do not submit false credentials or payment information.
• Do not misuse products or distribute them unlawfully.
• Do not exploit system errors, pricing issues, or unintended access.

5. Products and Availability

The Platform may display available products, restricted or provider-only products, and future or preview product categories. Displayed products may not always be available for purchase.

Products may include professional-use, cosmetic, skincare, or device-related items. The Platform does not provide medical advice.

• AQUAGOLD® VIP may change pricing, availability, and descriptions.
• AQUAGOLD® VIP may limit quantities.
• AQUAGOLD® VIP may cancel or refuse orders when necessary.

6. Account Credit and Bonus Credit

AQUAGOLD® VIP operates an internal account credit system. Credit may be used only for eligible purchases.

When placing an order, Bonus Credit is applied first, followed by Base Credit.

• Credit has no cash value except where required by law.
• Credit is non-transferable.
• Bonus Credit may expire based on program rules.

7. Payments

Payments are processed through Stripe. When a payment is successfully completed, the corresponding amount is applied as Account Credit.

Orders are fulfilled using available credit and do not trigger a separate external payment at checkout.

AQUAGOLD® VIP does not store full payment card details.

Payments are final once confirmed, except where required by law, a verified error occurs, or fraud or dispute resolution is required.

8. Loyalty Program

AQUAGOLD® VIP includes a tier-based loyalty system. Tier qualification is based on qualifying card-load activity and approved backfilled tier credit within a UTC calendar year.

Once achieved, a tier remains active for the remainder of the current year and the following calendar year.

Tier thresholds, benefits, and rules may be updated prospectively.

9. Checkout and Orders

Orders are placed through the Platform and paid using available Account Credit.

Before an order is accepted, pricing, availability, shipping, and credit balance are validated by the system.

Shopify is used as the backend system for order processing and fulfillment.

• AQUAGOLD® VIP may refuse orders that are unauthorized, incorrect, or inconsistent with platform rules.
• AQUAGOLD® VIP may cancel orders that are unauthorized, incorrect, or inconsistent with platform rules.
• AQUAGOLD® VIP may adjust orders that are unauthorized, incorrect, or inconsistent with platform rules.
• AQUAGOLD® VIP may review orders that are unauthorized, incorrect, or inconsistent with platform rules.

10. Order Records

Payment receipts are issued through Stripe for completed payments.

• Order confirmations include product details.
• Order confirmations include quantities.
• Order confirmations include pricing.
• Order confirmations include shipping.
• Order confirmations include applied credit.

11. Returns and Refunds

Unless required by law, payments applied to Account Credit are non-refundable and product sales are final.

Approved adjustments are typically issued as Account Credit.

• Exceptions may apply for incorrect shipments.
• AQUAGOLD® VIP may require proof of purchase before approving any claim.
• AQUAGOLD® VIP may require photos before approving any claim.
• AQUAGOLD® VIP may require product details before approving any claim.

12. Shipping

Shipping options are presented at checkout. Estimated delivery timelines may vary.

AQUAGOLD® VIP is not responsible for delays caused by incorrect or incomplete address details.

Tracking information will be provided when available.

• Customers are responsible for providing accurate shipping information.

13. Communications

AQUAGOLD® VIP may send transactional communications. These are not marketing communications.

• Account verification.
• Order confirmations.
• Shipping updates.
• Support messages.

14. Third-Party Providers

The Platform relies on third-party services. These providers operate under their own terms and policies.

Third-party providers are not responsible for product support, order issues, or customer service.

• Google Cloud / Firebase
• Vercel

15. Intellectual Property

All Platform content, branding, and design are owned or licensed by AQUAGOLD® VIP.

You may not copy, reproduce, or distribute content without permission.

16. Disclaimer and Limitation of Liability

The Platform is provided “as is.”

To the fullest extent permitted by law, AQUAGOLD® VIP is not liable for indirect or consequential damages, delays, or third-party service issues.

• AQUAGOLD® VIP does not guarantee error-free operation.
• AQUAGOLD® VIP does not guarantee product availability.

17. Changes to Terms

AQUAGOLD® VIP may update these Terms.

Continued use of the Platform constitutes acceptance of updated Terms.
